If you are downhill, water is coming your way — that is simply how gravity and lots work. The question is where you intercept it and how you handle it.
Confirm what is actually happening
Walk the property line during or just after a heavy rain and watch where water enters. Guesswork produces the wrong drain in the wrong place.
Distinguish natural sheet flow across a slope from concentrated discharge — a pipe, a downspout line, a driveway channel or a swale that ends at your line.
Note whether recent work uphill changed things: a new patio, driveway, addition, pool or regraded yard all add or redirect runoff.
Photograph it. A record of where and how much matters if a conversation becomes a formal one.
Intercept high, not low
The cheapest fix is almost always to catch water where it enters, at the upper boundary, rather than dealing with it after it has crossed the yard.
A swale — a shallow shaped channel across the slope — carries flow sideways to a safe outlet and handles large volumes.
A French drain along the upper line collects subsurface and slow surface water where a swale is impractical.
Where flow is concentrated, a catch basin at the entry point piped to a proper outlet is usually the right answer.
Whatever you build must lead somewhere with capacity — a lower boundary, a street outlet where permitted, or a suitably sized dispersal area on your own land.
Things not to do
Do not build a berm or wall that blocks flow at the line. Water backing up onto a neighbour's property creates a new dispute and often a worse problem.
Do not pipe collected water onto the next property down. Concentrating and discharging runoff onto someone else is exactly what you object to happening to you.
Do not assume you may work on or across the property line. That requires the neighbour's agreement.
Do not start major regrading near a boundary without checking local requirements first.
The conversation and the legal side
Most of these situations resolve with a friendly conversation, particularly where the uphill neighbour is unaware their downspout or new driveway is the cause.
In an HOA neighbourhood, the association may have a role, especially where common areas or approved plans are involved.
